Terms of Service

Acceptance of Terms

By accessing or using the Adriatic Houses Media website and/or booking our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use this website or submit a booking request.

These Terms apply to all visitors, clients, and users of the site. No user account or authentication is required to browse the site or request a booking.

Services Overview

Adriatic Houses Media provides real estate photography and related media services, including interior and exterior property photography, aerial drone imagery, 360° virtual tours, virtual staging, 2D floor plans, and property videos. Deliverables depend on the package selected or the custom quote agreed upon in writing at the time of booking.

We reserve the right to decline a project if the property is unsafe, inaccessible, located outside our coverage area, or incompatible with our equipment or scheduling. Any additional services requested after booking may require a separate quote.

Booking and Scheduling

Bookings are submitted through Tally.so forms linked on our website. Submitting a booking request does not automatically confirm an appointment; availability is confirmed by Adriatic Houses Media via email or telephone.

All information submitted through the booking form must be accurate and complete. Booking data is processed by Tally.so in accordance with their terms of service and privacy practices. Personal data is stored and processed within the European Union.

Cancellation and Rescheduling

You may reschedule or cancel a confirmed shoot without charge if we receive your request at least 48 hours before the scheduled start time. Cancellations or rescheduling requests received less than 48 hours before the shoot may be subject to a cancellation fee of up to 50% of the quoted service fee.

No-shows, cancellations after our photographer has arrived on site, or inability to access the property at the scheduled time may result in a charge equal to the full service fee. We will make reasonable efforts to accommodate rescheduling due to exceptional circumstances.

Payment Terms

Payment terms are specified in the invoice or booking confirmation sent to you. Unless otherwise agreed in writing, a deposit may be required to confirm your booking, with the remaining balance due before final delivery of the edited materials.

All prices are quoted in Euros (EUR) and include applicable Italian VAT unless expressly stated otherwise. Late or incomplete payment may delay delivery or result in withholding of final files until the balance is settled.

Delivery Timeline

Standard edited deliverables are provided within 48 hours of the completed shoot, excluding weekends and Italian public holidays, unless an express 24-hour delivery option has been purchased. Delivery timelines begin once the property is ready, access has been provided, and any required payment has been received.

Deliverables are supplied via a secure download link or another agreed digital transfer method. Larger properties, custom projects, or shoots requiring additional editing may have extended timelines, which will be communicated and agreed in writing before the shoot.

Intellectual Property and Usage Rights

All photographs, videos, drone footage, 360° virtual tours, floor plans, and other creative materials produced by Adriatic Houses Media remain the intellectual property of Adriatic Houses Media unless a separate written assignment of rights is expressly agreed.

Upon receipt of full payment, the client receives a perpetual, non-exclusive, non-transferable license to use the delivered materials for the marketing, advertising, and sale of the specific property for which the materials were originally created. This license does not permit resale, sublicensing, or use that is defamatory, unlawful, misleading, or outside the scope of the original property listing.

Unless the client requests otherwise in writing before delivery, we reserve the right to use selected, non-confidential images and videos in our portfolio, website, social media, and other marketing materials. We will respect reasonable requests to keep a property or address private.

Client Responsibilities

The client is responsible for ensuring that the property is clean, well-lit, accessible, and adequately prepared for photography at the scheduled time. Personal belongings, valuables, and any items the client does not wish to appear in the images should be removed before the photographer arrives.

The client must obtain all necessary permissions for aerial drone operations, building access, parking, and compliance with any condominium, municipal, or third-party property rules. Adriatic Houses Media is not responsible for delays or cancellations caused by lack of access, unsafe conditions, or failure to secure required permissions.

Limitation of Liability

To the fullest extent permitted by applicable law, the total liability of Adriatic Houses Media for any claim arising out of or relating to our services is limited to the amount actually paid by the client for the specific shoot in question.

We are not liable for any indirect, consequential, incidental, or special damages, including but not limited to lost profits, lost sales, or missed listing opportunities, except where such limitation is prohibited by Italian or EU law. We are not responsible for delays caused by weather, unsafe flying or shooting conditions, lack of access, or events beyond our reasonable control.

Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Italian Republic and, where applicable, the laws of the European Union. Any dispute arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Trieste, Italy.

Before initiating any formal proceedings, the parties agree to attempt to resolve disputes in good faith through direct correspondence.

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. The current version will always be posted on this page with the date of the last update.

Continued use of the website or our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

What personal data we collect

We collect only the personal data necessary to respond to your enquiries and provide our photography services. This may include your name, email address, phone number, the address of the property to be photographed, and any other details you choose to provide in your message or booking form.

We do not request sensitive personal data (such as health information, racial or ethnic origin, or political opinions) and ask that you do not include such information in your communications with us.

How we collect your data

Most of the personal data we receive comes directly from you when you complete our contact form, send us an email, or submit a booking request through Tally.so forms embedded on this site.

We do not use automated decision-making or profiling based on your personal data.

Legal basis and purposes of processing

We process your personal data on the following legal bases under the GDPR: performance of a contract or pre-contractual steps at your request, your consent where explicitly given, compliance with a legal obligation, and our legitimate interests in operating our business and responding to enquiries.

Specifically, we use your data to: respond to questions and provide quotes, process and manage bookings, coordinate shoots and deliver edited media, communicate with you about your project, and comply with legal and accounting obligations.

Where your data is processed

Your personal data is processed within the European Economic Area (EEA). Our booking forms are hosted by Tally.so, which processes form submissions in the EU.

We do not transfer your personal data outside the EEA unless adequate safeguards are in place in accordance with GDPR requirements.

Third-party processors

We rely on carefully selected third-party service providers to operate this website and deliver our services. These include Tally.so for booking and enquiry forms, ImageKit for media hosting and image optimization, Vercel for website hosting and analytics, and our hosting provider for serving the website.

Each processor is contractually bound to process data only on our behalf and in compliance with applicable data protection law. We do not sell your personal data to anyone.

Cookies and similar technologies

We use Vercel Analytics to collect anonymous, aggregate information about how visitors use this website, such as page views and visitor geography. Vercel Analytics does not use cookies or personal identifiers to track individual users.

The only information stored locally in your browser is an optional consent preference that records whether you have dismissed our cookie notice, so that we do not show it again on subsequent visits. This preference is not used to identify or track you and can be cleared at any time through your browser settings.

Data retention

We keep your personal data only for as long as necessary for the purposes for which it was collected. Enquiry and booking records are generally retained for up to seven years to comply with Italian accounting, tax, and legal obligations, after which they are securely deleted or anonymized.

If you ask us to delete your data earlier and there is no overriding legal reason to retain it, we will do so promptly.

Your rights

Under the GDPR, you have the right to: access the personal data we hold about you, request correction of inaccurate or incomplete data, request erasure of your data ("right to be forgotten"), request restriction of processing, object to processing based on legitimate interests, and request a copy of your data in a structured, commonly used, machine-readable format (data portability).

Right to lodge a complaint
